Earlier this week, when swearing-in newly-seated Senator Rand Paul, Vice President Biden, who serves as President of the Senate, said, "I never get along with any interest groups in the United States Senate. The only one that I really respect, and I don't agree with them most of the time, is the ACLU. Because they never, never vary. They have principles."

We certainly appreciate the shout out from Vice President Biden. He understands what the ACLU has always been about at our core: we are committed to preserving and defending the Constitution and the Bill of Rights and ensuring that our rights and liberties are afforded to all, regardless of background or political belief. These principles have guided us well as an organization for over 90 years — and our country for over 200 years. We are proud of being the nation's foremost advocate for the rights of all, and we appreciate the Vice President's respectful acknowledgement of our work.

It's Your Move, Congress: Stand Up for Net Neutrality

Late last month, the Federal Communications Commission (FCC) passed a new rule clarifying the FCC's legal authority to enforce network neutrality principles. Network neutrality, also known as "net neutrality," principles protect free speech online by prohibiting the owner of a network from prioritizing some types of content on the Internet while slowing down others.

First, the good news: the new rule prohibits wired broadband owners — usually telecom companies like Comcast and Verizon that provide cable and DSL service to homes and offices — from discriminating against information by throttling, slowing or otherwise tampering with the transfer of any data on the wired Internet.

Now, the bad news, and it's pretty bad: the rule is on shaky legal footing and it doesn't apply to wireless Internet — the kind you access on your cell phone. The legal question is particularly frustrating. After the D.C. Circuit rejected the FCC's last efforts to establish open internet rules — largely because of questions over FCC authority — the ACLU and many other groups argued that broadband providers offer a telecommunications service and should therefore be regulated like telephone companies. Such a change would provide robust protections. Sadly, the FCC bowed to industry pressure and refused to adopt this change.

"By creating two sets of regulations — one for the wired Internet and one for wireless broadband — and failing to ground them in the strongest legal protections available, the FCC has failed to protect free speech and Internet openness for all users," said Chris Calabrese, ACLU Legislative Counsel. "The ACLU will continue to fight for full network neutrality protections. Internet openness is key to protecting our First Amendment rights."

Now that the FCC has voted, this issue is in Congress's hands.

Unconstitutional Bill Aims to Subvert 14th Amendment

Ask your representative to reject attacks on the 14th Amendment.

On Wednesday, a day before members of Congress recited the Constitution on the House floor and affirmed their commitment to defend and uphold it, an unconstitutional bill designed to subvert the citizenship clause of the 14th Amendment was introduced.

The bill introduced in the U.S. House of Representatives by Rep. Steve King (R-IA), attempts to subvert the 14th Amendment by rewriting the citizenship clause to restrict citizenship to only three categories of people: children of U.S. citizens or nationals, children of permanent residents and children of non-citizens in active-duty military service. The proposed legislation violates the constitutional guarantee that all people born in the U.S. and under its jurisdiction are U.S. citizens entitled to equal protection under the law. Further, it would violate long-established Supreme Court precedent. In addition, this radical proposal would deny citizenship to large segments of U.S. society including U.S.-born children to parents with lawful status such as refugees, foreign investors, scientists, engineers, artists, athletes, scholars and graduate students.

Also on Wednesday, a group of state legislators announced that they will introduce bills intended to deny Americans the fundamental protections of the 14th Amendment by requiring their states to deny standard birth certificates to many U.S. citizen babies born in the U.S. to immigrant parents.

"Citizenship for all born on U.S. soil has been one of the Constitution's most essential engines of equality and fairness under the law," said Laura W. Murphy, Director of the ACLU Washington Legislative Office. "It is too important to be defined by the political whims of any era."

Since its creation, the Constitution has guaranteed U.S. citizenship to every child born in the U.S., with very limited exceptions. Constitutional citizenship represents America's commitment to equality, fairness and justice under the law. Adopted in the aftermath of the Civil War, the 14th Amendment negated one of the Supreme Court's most infamous rulings, the Dred Scott decision of 1857, which held that neither freed slaves nor their descendants could ever become citizens. The Amendment, which guaranteed the constitutional rights of citizenship for all who were born in this country was enacted in response to laws passed by the former Confederate States that prevented African Americans from entering professions, owning or leasing land, accessing public accommodations, serving on juries and voting.

In 1898, the U.S. Supreme Court addressed the guarantee of the 14th Amendment and affirmed the fundamental principle that children born on American soil are U.S. citizens without regard to their parents' status. In United States v. Wong Kim Ark, the Court held that a baby born in San Francisco to Chinese parents who were subjects of China and were prohibited by law from becoming U.S. citizens was a citizen at birth under the 14th Amendment.

This principle has been the settled law of the land for more than a century.

State Legislators Considering Unconstitutional and Un-American Immigration Laws

Tell your governor: What happens in Arizona stops in Arizona!

Several state legislators around the country are considering proposing anti-immigrant legislation in the coming session, according to an article in The New York Times last week. In some states, the legislation would be similar to the recent Arizona racial profiling law, even though the worst provisions of that law have been suspended by a federal court. The ACLU, which brought a lawsuit challenging Arizona's racial profiling law, called on state legislators to reject the bills when they are introduced.

"Laws like Arizona's that cause racial profiling or deny other basic rights are unconstitutional, unfair and quintessentially un-American," said Laura W. Murphy, Director of the ACLU's Washington Legislative Office. "The courts were correct to reject Arizona's draconian legislation, and other states should think twice before attempting to pass similar laws that have no place in an America that believes in fairness, equality and human rights. The ACLU will fight these misguided attempts across the country to upend our most fundamental American values."

What Do These Three Things Have in Common?

Swearing at the clogged toilet in your home
Flipping off a police officer in a dispute over a parking space
Yelling "asshole" at a motorcyclist who swerves close to you

They could get you cited for disorderly conduct in Pennsylvania. Or even worse, thrown in jail — until now. The ACLU of Pennsylvania successfully defended about a dozen individuals against these kinds of charges — and won. This week, the Pennsylvania State Police (PSP) agreed to stop citing individuals for disorderly conduct for the use of profanity. Additionally, PSP will provide mandatory training to its officers about free speech.

According to information obtained by the ACLU through a Right to Know request, the PSP issued more than 750 disorderly conduct citations for profanity in a recent one-year period.

"Besides being a waste of police resources, these types of citations are often used by police to 'punish' people who argue with them. We are very happy the state police will proactively address this problem," said Mary Catherine Roper, senior staff attorney for the ACLU of Pennsylvania.

Government Should Investigate Denials of Emergency Care at Religiously-Affiliated Hospitals

Tell Secretary Sebelius to stop religiously-affiliated hospitals from putting women's lives at risk.

The ACLU has asked the Centers for Medicare and Medicaid Services (CMS) to investigate potential denials and delays of emergency abortion care at religiously-affiliated hospitals in violation of federal law, specifically the Emergency Medical Treatment and Active Labor Act and the Conditions of Participation of Medicare and Medicaid.

The request followed the decision by St. Joseph's Hospital in Phoenix to continue providing life-saving abortions when necessary despite pressure from the Catholic Diocese of Phoenix to discontinue the practice. The Bishop of Phoenix stripped the hospital of his endorsement when St. Joseph's correctly defended its decision to provide a life-saving abortion to a young mother of four in need of emergency care last year and asserted that it would continue to provide life-saving services.

"The hospital did the right thing by upholding its obligations to provide necessary health care, but this incident just underscores the need for the government to make crystal clear that hospitals — regardless of religious affiliation — must provide necessary life-saving care to patients," said Alexa Kolbi-Molinas, staff attorney with the ACLU Reproductive Freedom Project. "A hospital's first duty is to its patients. No woman should ever have to be afraid that she will not receive the care she needs when she goes to a hospital."

A 2008 article in the American Journal of Public Health highlighted a worrying pattern of religiously-affiliated hospitals denying emergency reproductive care to patients. The article cites instances in which miscarrying women were forced to travel to another facility after religiously-affiliated hospitals refused to terminate their pregnancies — and a woman who was denied care until the moment her fetus' heartbeat stopped, placing her in grave peril.

"Religiously-affiliated hospitals are not exempt from federal law that requires them to provide emergency care to their patients," said Vania Leveille, ACLU Legislative Counsel. "The government must ensure that all hospitals that receive federal funding are in compliance with the law."

Justice Denied: Activists Imprisoned, SOA Remains Open
Federal Judge sentences SOA Watch activists to six months in prison
Once again, the justice system's complicity with the abuses taught at the School of the Americas was exposed yesterday at the trial of anti-militarization activists Nancy Smith and Chris Spicer. Nancy, from New York, changed her plea to no contest and was immediately sentenced to 6 months in prison by Magistrate Judge Stephen Hyles. In the SOA Watch tradition of using the court to put a spotlight on the SOA/WHINSEC, Nancy affirmed that she "felt a strong moral imperative" to carry out her nonviolent act of civil disobedience "on behalf of those who have suffered so terribly".

Chris, from Illinois, plead not guilty but was declared guilty by Judge Hyles and sentenced likewise to 6 months. In his closing statement before sentencing, Chris addressed the ongoing human rights abuses in Latin America carried out by graduates of the School of the Americas, and his need to confront the "paralysis of fear" that has gripped the country in recent times.

In November, Franciscan priest Fr. Louis Vitale, OFM and David Omondi of the Los Angeles Catholic Worker Community both pled no contest and were sentenced to the maximum 6 months in jail.

The decision by Judge Hyles to impose the maximum penalty for a nonviolent act of civil disobedience exposes the political nature of the trials and the justice system. However, we take the energy of Nancy, Christopher, David and Louis, along with the thousands of our brothers and sisters who have been massacred, raped, tortured and disappeared in their fight for a culture of peace with justice, and we will continue to move forward. We hope to see you all in Washington, DC, in April to bring the fight to close the SOA and end US militarism to the doorsteps of our policy makers.

The struggle is long, but we will prevail!

Hope this email finds you well. We just received the letter below from prison from Father Louis Vitale. Fr. Louis was arrested together with David Omondi, Nancy Smith and Chris Spicer by the Fort Benning military police during the November Vigil when they carried the call to close the SOA onto the military base. Father Louis and David were sentenced immediately to six months in federal prison. Nancy and Chris are currently preparing for their federal trials on January 5, 2011. They will use the courtroom to put the SOA itself on trial. Several others are also still facing charges after having been arrested by the Columbus police following the rally on November 20, 2010. Support the SOA Watch Legal Defense Fund with a contribution today. You'll find addresses to write to the prisoners below.

Letter from Father Louis Vitale, SOA Watch Prisoner of Conscience:

Two weeks have passed since David Omondi and I began our sojourn here at Irwin County Detention Center in southern Georgia. Some may say, "Vitale has protested himself back into the pokey below the Mason-Dixon line" and "He has been jailed again in an effort to bring peace and social justice." SF Chronicle 11/28

Many ask, "Why do you keep doing this?" We try to respond: "Because the oppression goes on and our nation is a major participant in that oppression of the poor and of all creation." Specifically this manifestation of mourning focuses on the School of the Americas (WHINSEC) at Ft. Benning, Georgia, where U.S. military have taught counter-insurgency techniques, including torture and disappearance, to Latin American military. It still goes on, as recently observed with the outrageous coup in Honduras carried out by graduates of the School of the Americas. In fact, our involvement in oppressive militarism extends throughout the world!

But why so many times at Ft. Benning (my fourth arrest and incarceration, and so far from my home base)? The School of the Americas is an icon of our intrusion into developing countries over many years and the source of horrific massacres including religious leaders and thousands of peasants. Also Ft. Benning is a major military base feeding vast numbers into the war machine. Thousands gather annually to mourn the victims and to call for an end to our war machine that continues to grow into more bases, nuclear weapons manufacturing facilities, even into space war (and the new X-37B militarized version of the space shuttle).

Are we ready to declare peace and act in its presence? Let's call - with all our energy - for nonviolent solutions now, transforming many peoples' lives and our world. Our work is cut out for us as we must be vigilant and active with nonviolent resistance. May we move towards peace in the new year.

[Louie, serving a 6 month sentence for trespass at Ft. Benning, was moved from the Irwin County Detention Center on December 15, and is currently in transit. We will let you know as soon as he reaches his final destination.]

In the aftermath of Honduras's 2009 coup, security forces under the de facto government beat demonstrators, detained people arbitrarily, and shut down media outlets.

Since the inauguration in January of President Porfirio Lobo, who was elected after the coup, at least 47 journalists, human rights defenders, and political activists have been threatened or attacked -- 18 of them killed. Circumstantial evidence in most of these cases suggest that victims were targeted because of their political views.

No one has been held accountable for these acts, nor for what happened in the coup's aftermath.

Court cases concerning crimes committed after the coup have been stalled – in part because various state agencies won't cooperate with Honduras's human rights unit. Security forces have failed to turn over firearms for ballistics tests and ignored requests to identify officers accused of crimes. Investigations into the officers' actions lack independence.

The Supreme Court endorsed the military's actions during the coup and fired four judges who questioned the coup's legality, creating a climate that discouraged lower-court judges from ruling against the de facto government.

Until Honduran authorities take concrete steps to hold people accountable for past actions and to stop the attacks, it will be difficult to restore trust in the country's democratic system.

Human Rights Watch urges the Defense Department to implement rapidly the "Don't Ask, Don't Tell Repeal Act of 2010." As documented in our 2003 report, "Uniform Discrimination: the 'Don't Ask, Don't Tell' Policy of the US Military," men and women who have served their country with courage, skill, and distinction have been discharged from the US military simply because of their sexual orientation. Since the policy was enacted in 1993, 14,000 service members have been wrongfully discharged.

President Obama's repeal of the discriminatory legislation was a major step forward in affording equal rights to lesbian, gay, and bisexual people and corrects a serious injustice inflicted upon men and women by the country for which they were willing to sacrifice their lives.

I know the Occupation in and out - I lived under it my entire life,
but even I cannot imagine being in Adnan Gheith's position. I don't
want to believe that something like this is possible, and I want to do
all I can to stop what Israel is trying to do to him.

On November 28th, Adnan, a Silwan grassroots organizer, received
written notification that Israel intends to issue an order expelling
him for a four months period from his city - Jerusalem. Adnan is a
resident of Silwan, and a member of the al-Bustan Neighborhood's
committee, which was formed to oppose plans for massive house
demolitions. In a reality where Palestinians' right for freedom of
expression in not even lip service, organizing your community against
its impending destruction is reason enough to be ripped from it.

The order against Adnan is not part of a legal process where
suspicions, charges or evidence have any part. It is an administrative
order that circumvents the rule of law, which forms the foundation of
western democracy. In this harsh reality, a person's rights are taken
without due process, with no charges, based on secret evidence and
with no possibility to truly defend oneself. It is the essence of a
Kafkaesque legal procedure in the taunting maze of the Occupation's
bureaucracy and power.

But it is not too late to act up and make a difference. Adnan's
expulsion from his city and family and life, can be prevented.

Dear Friend of Palestine,
We have just returned from an eye-opening three-week trip to the West
Bank and Gaza, where we visited 33 of our partner organizations.
Grantees and ordinary Palestinians alike gave us a stark picture of
the economic reality on the ground in Palestine. Despite reports
that the West Bank economy is booming, most Palestinians told us that
they were not benefiting from recent growth, which is concentrated in
Ramallah. Despite the recent "easing" of the Israeli blockade, the
World Bank estimates that unemployment is at 39%, and 96% of private
sector jobs have been eliminated since 2007. Palestinians told us
that they don’t want "handouts" – they want to live and
work in their homeland and exercise greater control over their lives.
In the short-term, we cannot expect an end to the Israeli occupation
and the blockade, which is essential for large-scale economic revival.

In 2010, executions in the U.S. continued (in only 12 states), states
resorted to secret (probably illegal) drug purchases to feed their
execution habit, and authorities failed to guarantee that no innocent
person will be executed. Not surprisingly, a recent poll found that

New online publication frames a discussion of contemporary art and its
modern history as considered from
Los Angeles

The launch of East of Borneo marks the convergence of two very
distinct lines of thought. What is the nature, and the future, of art
magazines? And how might we give form to the sprawling history of art
in Los Angeles, a form that can be generative and productive, not
merely descriptive or fancifully speculative?

Launched in October 2010, East of Borneo is a collaborative online
art journal and multimedia archive that offers a new way to research
and present the various histories of contemporary art. Its hybrid
form—which publishes newly commissioned art writing within a larger
context of user generated material—reflects an editorial process of
thinking through the delights and constraints of printed magazines,
and fully considering the transcendent possibilities of online
publishing today.

East of Borneo is a new model for art publishing that rethinks
traditional editorial structures, using the power of networked
collectivity to create depth and complexity. Articles incorporate
web-savvy multimedia footnotes that offer readers immediate access to
the primary materials--video, images, links and texts--that the
writers have used in their research. Readers can upload additional
items of their own, creating a growing archive of relevant content
that activates and enriches the editorial material, highlighting
unexpected connections and encouraging new lines of thought.

As you navigate the site today, you'll find a range of content that
reflects the sprawling, rhizomatic nature of Los Angeles as well as
the broader international art world.

government engages in regularly.

When they're not groping us at airports...
...showing up at our front doors for "clarification"
of our political ideas...or sending paid operatives
to pose as members of community groups...
they like to play this game:

Sending police dressed up as demonstrators
to turn peaceful protests into riots.

This video comes from Canada, but the
technique is used in the US every day of
the week.

The truly bizarre thing is no one seems
to know about it.

Every demonstration should have teams
specifically charged with identifying these
gun thugs (they're easy to find), pointing
them out, and blowing their cover.

It's a matter of public safety as these creeps
are there specifically to incite violence.

Dear David,

On December 10, International Human Rights Day, in 23 cities across America people of conscience took a historic stand for justice and equality for all people in the Middle East.

Side by side, Jews, Christians, and Muslims went to 23 individual offices of the US's leading pension fund, TIAA-CREF, and said do not use my money to profit from the Israeli Occupation. TIAA-CREF, divest from Caterpillar and other companies that profit from breaking the law, harming others and preventing peace.  

You can watch the video for yourself to see people of every age in cities large and small across the United States—from New York City to Iowa City, and from Washington DC to Seattle, Washington—all telling TIAA-CREF to stop profiting from destruction.  

TIAA-CREF is one of the largest pension funds in the world, and they have invested over a quarter billion dollars in Caterpillar, which manufactures the bulldozers used by the Israeli government to demolish thousands of Palestinian homes and life-sustaining orchards. Caterpillar D-9 bulldozers are an essential tool of an occupation that steals land, destroys livelihoods and injures or kills civilians.

  Every day that TIAA-CREF holds onto Caterpillar stock is another day in which the financial giant profits from these human rights violations.

  In some TIAA-CREF offices, company representatives received a copy of our divestment petition or met cordially, in others they distributed a form letter in response, and in one office they refused to honor a scheduled appointment with someone who has been invested with TIAA-CREF for 50 years.   

TIAA-CREF simply does not offer participants an option for investments free from supporting the occupation. Even their socially responsible funds invest in Caterpillar.

Last Friday, December 10, was just the beginning. Additional TIAA-CREF participants have scheduled appointments to return to discuss their concerns. Many more continue to gather signatures for our divestment petition--we know that every signature from a TIAA-CREF holder makes a difference.

  "We went to the University of Louisville, and together with the local Students for Justice in Palestine we collected 260 signatures for the TIAA-CREF petition in about 4 hours. That's more than one signature a minute."

By the time she was in high school, Sarah Smith had already been named one of the 100 most influential women in Chicago by Chicago's business magazine, Crain's. Now Smith, who happens to be Jewish, has been subpoenaed by the FBI to appear before a grand jury on January 25 to explain her trip to Israel-Palestine with two Palestinian women friends. (As terrifying as this whole episode is for everyone involved, it says something about Palestinian safety that only Smith has come forward publicly.) All three young Chicago residents have been subpoenaed, joining ranks with 14 other peace activists from the Midwest who have been similarly targeted in recent months.
Here is Sarah Smith's full statement from a December 6 press conference:

Friday morning, December 3, I received a phone call from an FBI agent. He asked if I had about 30 minutes to sit down and speak with him so he could ask me some questions. I asked about what and he said he "was not at liberty to discuss it." I then asked if I needed a lawyer present and he said it was up to me but that I was not in any trouble and that they just had a few questions.
I felt something suspicious about him telling me he wanted to ask me some questions, but he would not tell me what these questions were. So I said that I had to consult a lawyer and check my schedule and that I would get back to him. I reiterated that it would be easier for me to meet him if I knew why an FBI agent wanted to sit down with me. He then said that it had to deal with the trip I took this summer. He then emphasized, "I think you know which one I'm talking about."
The trip I took last summer was to Israel and Palestine. I am Jewish and wanted to see first hand what life is like for Israelis and Palestinians. If I went on the standard tour to Israel, I would not be shown how Palestinians live. So I went on a tour that showed me both worlds, Israel, and the Israeli occupied Palestinian West Bank. I went with 2 Palestinian-American friends. You would think Jews and Palestinians going together to visit Israel and Palestine is something the U.S. government would encourage.
Instead, we are now being ordered by the FBI to go before a Grand Jury for going on that trip. The US government says it supports peace between Israel and Palestine. It says it supports separate Israeli and Palestinian states.
So why does the FBI investigate us because we went to see the Palestinian land? Top US government leaders meet with Palestinian leaders, so why does the FBI investigate us because we talked to average Palestinians on the street?
I went there so I could make up my own mind and talk about what I saw. It seems to me our government wants to hide what Israel is doing to Palestinians. Smith's father, Stan Smith, added "I think Patrick Fitzgerald, the US District Attorney, Robert Parker of the FBI need to see my daughter and her friends and apologize to them. And I think President Obama, who was elected in 2008 because he said he would stop this sort of thing, should make a point on his next trip to Chicago to personally apologize to my daughter and her friends for how his government is intimidating them."
Meanwhile, there are actions across the country to protest this crackdown on peace activists (sign the petition here). Firedoglake's Kevin Gosztola has this report :

The hunting down of activists began on September 24th when the FBI raided homes and offices of activists from Minneapolis and Chicago. Computers, phones, documents and other personal items were seized and the FBI officially subpoenaed 14 activists to appear before a Grand Jury. The FBI began to contact members of the "peace community" and ask them what they knew about the subpoenaed activists' "material support for terrorism."
The attorneys representing the activists have noted "the current definition of "material support' can cover just about anything, like providing humanitarian aid that ends up in the hands of a group tagged as 'terrorist' by the US government, or posting a link to an informational website. The implications of this law, as it is being used, are troubling to anyone who does community organizing, or anyone who does journalistic reporting or academic research on wars, conflicts or controversial movements."
Months later, the activists in Minneapolis and Chicago have not been charged with a crime, but they continue to face possible jail time if they refuse to go before a Grand Jury and participate in this "witch hunt." They have yet to have their belongings, which were seized by the FBI, returned.

In the pages of the quarterly the authors discuss the possibilities and limitations of the condition of silence by examining its presence in art and music across a number of global socio-political contexts. Several authors tackle the concatenation of sound, history and nation, working towards an understanding of the dynamics and power of silence. Defne Ayas discusses the recently realized Blind Dates curatorial project, which aimed to outline the challenges of engaging issues fraught with the multi-layered histories of the Anatolian landscape and its overlapping nationalized contexts. Aslihan Demirtas, who took part in the Blind Dates project, discusses the ancient Armenian city Ani—a charged historical site that reflects the tensions between contemporary Armenia and Turkey. Meanwhile, Anne Barlow considers the absence of specific 'cultural indicators' in Antarctica as a means to reveal the potential for a non-nationalized space. The next group of essays offer a more self-reflective look at silence, working through personal narratives and collective memory. Regine Basha's video essay navigates YouTube videos to trace instances of the song 'Fog il Nakhal' as it transforms through various voices and instruments. Similarly, Tony Chakar knits together religious and literary sources to form a personal narrative, duly influenced by his experience of his home city of Beirut. Dan Cameron directs our attention to various works that activate our auditory senses by visually addressing our collective memories; by giving a philosophical account of the notion of sound-scape and its relation to our bodies, he points to its intrinsic importance in the acts of listening and thinking. The remaining artists in *Silence* take on the mechanics of sound and its relationship to the body and performance: Micah Silver weaves through the history of music to offer viewers a rich chronicle of silence in sound-based practices, while Cevdet Erek addresses tinnitus, the perception of a ringing noise in the ear that often occurs after extreme exposure to a loud sound. Erek draws our attention to the creative possibilities of tinnitus and provides various sound tracks of his recent work to accompany his text. Together, the writers, artists and curators in this edition of the quarterly frame silence as a rich terrain in which questions of subjectivity, memory and nationalism are probed and explored. 	LE GRAND MONDE of Mona Hatoum at the Fundación Botín Through 9 January 2011 Fundación Botín Marcelino Sanz de Sautuola 3. Santander, Spain www.fundacionbotin.org After her stay at Villa Iris, where she directed the international Fundación Botín workshop in July, the artist Mona Hatoum becomes the central figure of the exhibition Le Grand Monde, which is intended as an intense reflection on the world in which we live. This artist's work characteristically reflects her personal experience and aims at involving the spectator as much as possible, provoking contradictory sensations of attraction and rejection. Hatoum manipulates household objects and the dimensions and extensions of the human body, using very suggestive materials that have been selected beforehand with considerable sensitivity and emotional connotations. The selection of a total of 30 pieces was carried out in accordance with the curator, Chus Martínez, chief conservator at the MACBA (Barcelona). This artist's work should be considered within the framework of the sculpture of the latter half of the 20th century. Mona Hatoum began producing performances and later shifted to creating sculptures and large format installations with subtle references to minimalism and conceptual art. In her works, everyday objects are the central features of mental associations and attractive references. The two pieces, Hot Spot (2006) and Undercurrent (2008), with which this show begins are exemplary of this approach. They are of large dimensions and they occupy the entrance and central courtyard of the lower floor of the Fundación Botín exhibition space in Santander. Hot Spot is a huge globe with all the continents outlined in red neon that make a characteristic buzzing sound. According to the artist, it is a reflection of the fact that confrontation is not restricted to certain parts of the world, but pertains to all of it. Undercurrent is a large net on the floor, also circular in shape, in which there are interwoven electrical wires covered with red fabric and whose ends light up gradually almost like light bulbs. 3D Cities consists of three printed maps of the cities of Beirut, Kabul and Bagdad that have pieces cut out of them, perhaps as a metaphor for bombs and explosions on the urban topographies. Interior/Exterior Landscape, a recent installation previously shown at the Art Center of Beirut (Lebanon) comprises diverse elements related to the realm of biography and domesticity: a bed, a table with a chair embedded in it, a clothes hook or a cage with human hair; in Electrified (2002) a set of hanging kitchen utensils seem harmless but actually lead to electricity and therefore to danger. Mona Hatoum was born in Beirut in 1952. Her parents had emigrated there from Haifa. In 1975 she left Lebanon to settle in London and there she began her training and career in art, participating in the shows such as the seminal Sensation under the auspices of Charles Saatchi. She currently lives in London and Berlin. The exhibition Le Grand Monde opened on October 7th and it will be running until January 9th 2011. In addition to the works on display, there is a brief video featuring the artist and the curator, and a virtual tour. Furthermore, this Thursday December 16th the critic Javier Hontoria will present a commented tour of the exhibition at 8:00 in the evening at the Santander venue. The mission of the Fundación Botin is to contribute to the global development of society. 	Now is the moment to reconfigure our notions of time to reveal alternative ways of thinking and being for the future. In Close Encounters: The Next 500 Years Indigenous artists imagine the future within the context of present experiences and past histories. By radically reconsidering encounter narratives between native and non-native people, Indigenous prophecies, possible utopias and apocalypses, this exhibition proposes intriguing possibilities for the next 500 years. "We all in different measure have carved out the future," observes Hopi photographer and filmmaker Victor Masayesva, in his book Husk of Time. "We are all clairvoyants, soothsayers, prophets, knowingly assuming our predictions." Close Encounters brings together over 30 Indigenous artists from across Canada, the United States, South America, Europe, Australia and New Zealand, including newly commissioned work from Rebecca Belmore, Faye HeavyShield, Kent Monkman, and Edward Poitras. Jimmie Durham's sculptural work Pole to Mark the Centre of the World (at Winnipeg) challenges widely held ideas surrounding space and location, while James Luna's poignant installation The Spirits of Virtue and Evil Await My Ascension addresses issues of ritual and the passing of time. Close Encounters showcases artists and artworks that collectively invent provocative futures from a diversity of perspectives and practices. With its myriad histories, trajectories, tensions, collisions and self-image(s), the city of Winnipeg offers an intriguing juxtaposition for these artistic mediations. Close Encounters: The Next 500 Years presents international Indigenous perspectives in a city that in many ways also epitomizes the future of Aboriginal people in Canada. 	This winter de Appel presents the solo exhibition "Diamond Dancer" by the Belgian visual artist Valérie Mannaerts (Brussels, 1974). In spatial installations Mannaerts combines sculptures, spatial objects, works on paper and photography in spatial installations in a way in which the different types of imagery cut across each other. Using the exhibition spaces in de Appel Boys' School, Mannaerts creates a total installation with a selection of uninhibited and disparate objects. In her work Valérie Mannaerts extends the medium of collage to spatial objects. She examines the physiognomy of things and questions the relationship between organic and inorganic forms, the autonomy of objects and the stories concealed by them. Using materials such as wood, bronze, ceramics, cardboard, textiles, paint, concrete and paper Mannaerts created hybrid, controversial and ambiguous forms for this exhibition. Her work explores the boundaries between image and object in a way that is sometimes indirectly reminiscent of the work of the Surrealists. The words from the title "Diamond Dancer" are intriguing, because they appear to be a reminder of something that is difficult to place. Mannaerts' visual work results in the same experience. Her works enters border areas, twilight zones in which the viewer looks for visual points of contact in bewilderment. The viewer is confronted with an object or a situation which demands preverbal observation before it is analysed. The objects alternate between being a sketch or a drawing, a sculpture and an ornament, a model and a life-size representation, between two and three dimensions. The precise interpretation is up to the individual viewer, because as Mannaerts once said: "People see and recognise in the world around them that what is already in their head." Canadian grad student, Jewish anti-Zionist activist, and descendant of Holocaust survivors Jenny Peto is breaking new ground with her University of Toronto master's thesis The Victimhood of the Powerful: White Jews, Zionism and the Racism of Hegemonic Holocaust Education, though perhaps not in the way she intended.
The Canadian National Post reports:

It has provoked intense debate online, in academia and even the political realm. Progressive Conservative MPP Steve Clark raised it in the legislature Tuesday in response to sharp criticism in the Jewish community, calling it "shockingly anti-Semitic." Citizenship and immigration minister Eric Hoskins likewise condemned the thesis in the legislature saying he was "greatly disturbed and, in fact, disgusted," when he read media coverage about it.

These attacks (by some if not many who haven't actually read it) on a master's thesis, one that has already been through an academic review no less, are unprecedented. Also from The National Post:

Michiel Horn, a York University history professor and author of Academic Freedom in Canada: A History: "I know not of a single case where a master's or a phD paper has been subject of discussion in the legislature of any province in Canada," he said.

This paper focuses on issues of Jewish identity, whiteness and victimhood within hegemonic Holocaust education. I argue that today, Jewish people of European descent enjoy white privilege and are among the most socio-economically advantaged groups in the West. Despite this privilege, the organized Jewish community makes claims about Jewish victimhood that are widely accepted within that community and within popular discourse in the West. I propose that these claims to victimhood are no longer based in a reality of oppression, but continue to be propagated because a victimized Jewish identity can produce certain effects that are beneficial to the organized Jewish community and the Israeli nation-state. I focus on two related Holocaust education projects – the March of the Living and the March of Remembrance and Hope – to show how Jewish victimhood is instrumentalized in ways that obscure Jewish privilege, deny Jewish racism and promote the interests of the Israeli nation-state.

I myself can't wait to read it. There's not a lot here that those seriously familiar with these Jewish institutions and Israeli history and politics could really argue with. For too long, the central organizing principle of much of institutional Jewry has been fear, which has been essential in, among other things, enabling an unaccountable Israel. And few programs more dramatically reflect this than the March of the Living which inflicts a proxy Holocaust trauma on Jewish teenagers (without proper context and support, so I hear from friends who have gone) as an essential right of passage into Jewishness.
To the young N. American Ashkenazi Jews especially who can't help but notice that Jews as a whole occupy places of real economic and racial privilege in their communities, the messages of perpetual victimhood (and the implied privileges that might go with it, as in the case with the free pass that Israel tends to get) just don't compute.
I'd imagine that in addition to her own experience, Peto had plenty to draw on from work and discussions happening in academic environments these days regarding Holocaust studies, Israeli politics, white privilege and so on. Is it possible that Peto's crime is to have thought too complexly –in an academic setting.

Civil Union Bill Passes in Illinois

Illinois changed the course of history last week.

By a vote of 32-24, the Illinois Senate approved the Illinois Religious Freedom Protection and Civil Union Act, which will extend important legal protections to gay, lesbian and straight couples across the state. Now, the bill moves on to the desk of Gov. Pat Quinn, who has promised to sign it.

The ACLU helped draft the bill, offered legal analysis to legislative leadership, met with editorial boards, conducted polling in targeted districts, and put significant effort into lobbying the bill over the course of four years. Constituent visits, patch-through calls, and the phone and e-mail messages of ACLU members all contributed to this bill's passage.

With the new Illinois law, 17 states in addition to the District of Columbia now have some form of state-level protection for same-sex relationships. We haven't reached our ultimate goal — the freedom to marry for same-sex couples in every state, and respect for those marriages by the federal government. But we've achieved quite substantial progress; before 1997, we had no state-level relationship registries at all.

The Illinois bill will provide important protections to same-sex couples, including medical decision-making authority; pensions for surviving partners of teachers, police officers, and firefighters; intestacy rights; and the right to share a nursing home room. We will continue to push for marriage in Illinois as elsewhere, but the civil union bill continues a clear trend line toward the increasing of fairness in how we treat all families.

Reconciling Faith and Evolution in the Classroom

Susan Epperson's case in the U.S. Supreme Court resulted in the overturning of an Arkansas law that prohibited the teaching of evolution in public schools.

This month, it's been five years since the Kitzmiller v. Dover Area School District decision, which ruled that "intelligent design" is a religious idea that may not be taught in public school science classes. And just this week, Louisiana's State Education Board approved new biology textbooks for Louisiana high school students, over the objections of those who say the new books put too much credence on Darwin's Theory of Evolution.

We sat down with Susan Epperson, plaintiff in Epperson v. Arkansas — a case argued before the U.S. Supreme Court in 1968 that challenged the constitutionality of a state to outlaw the teaching of evolution in public school — to get her thoughts on her experience. In her case, with a 9-0 vote, the Court overturned an Arkansas law that prohibited the teaching of evolution in public schools on the grounds that it violated the Establishment Clause of the First Amendment. The ACLU, as amicus curiae, urged reversal of the judgment of the Supreme Court of Arkansas.

Senate Vote Blocks Repeal of DADT… For Now

Tell your senators that you want DADT repealed this year.

Yesterday afternoon, the US Senate tried — and failed — to begin debate on the National Defense Authorization Act (NDAA), preventing the repeal of the discriminatory and unconstitutional "Don't Ask, Don't Tell" policy from advancing in the Senate — despite the support of a majority of senators and the personal pleas of President Obama, Defense Secretary Bob Gates, and Chairman of the Joint Chiefs of Staff Adm. Mike Mullen. The Senate missed an historic opportunity to finally end this unjust and unfair policy. However, we may get another chance — and sooner than you think.

Following the vote, Senator Joseph Lieberman (I-CT) announced that he and Senator Susan Collins (R-ME) intend to introduce a stand-alone bill that would repeal DADT. Senate Majority Leader Harry Reid (D-NV) has said he intends to attempt to bring this legislation to the floor before the end of the year. And Speaker Pelosi announced that the House of Representatives stands ready to pass the new DADT repeal bill as soon as the Senate passes it, leaving the possibility open that DADT could still be repealed this year! The fight continues, and senators need to hear it loud and clear from the American people: We want this senseless discrimination to end this year!

Those service members who are gay and lesbian — and are willingly risking their lives in our armed forces — deserve nothing less than the integrity that comes from being able to serve their nation with honesty. There is absolutely no excuse for failing to act. As Adm. Mullen so eloquently stated in testimony before Congress recently, "I would not recommend repeal of this law if I did not believe in my soul that it was the right thing to do for our military, for our nation and for our collective honor."

The ACLU remains fully committed to ending DADT and will continue to fight, both legislatively and in the courts, to ensure that our nation's service members are able to serve with honesty and integrity.

Seeking Domestic Partnership Protections in Missouri

State highway patrol officer Dennis Engelhard was struck by a vehicle and killed while on duty. His life partner was denied the pension benefit that Missouri provides to the surviving spouses of state troopers. Watch a video about Dennis and Kelly's life together.

Last week, the ACLU filed a lawsuit seeking fair treatment for the surviving partner of a Missouri state trooper. Dennis Engelhard and Kelly Glossip were together for 15 years. They exchanged commitment rings, vowed to take care of each other in good times and bad, and owned a home together. Dennis helped Kelly care for his child from a former marriage. The two would have married if Missouri recognized their union.

Dennis was a state highway patrol officer and had to work on Christmas day 2009. While on duty, he was struck by a vehicle and killed as he was responding to a traffic accident. Despite Kelly and Dennis's long-term, committed relationship, Kelly wasn't eligible for the pension benefit that Missouri provides to the surviving spouses of state troopers. In Missouri's eyes, the two were legal strangers.

This case challenges the unfairness of the state refusing to provide this important protection to Dennis's surviving life partner, whose life is affected in the same devastating way that a surviving spouse would be. After having completed a lengthy state administrative process, the ACLU filed in state court, arguing that the state needs a very good reason to justify penalizing Kelly and Dennis because of the family relationship they formed.

Kelly's case builds on similar discrete domestic partnership benefits successes we've had in Alaska, Montana, New Mexico, and Wisconsin, and our aim is both to help Kelly (and others like him) and to prompt the state to recognize domestic partners more generally.

If we're going to add to that list of states with relationship protections, we're going to have to work in more conservative states like Missouri. Stories like those of Kelly and Dennis — that are heart-wrenching precisely because of the commitment at the center of the tragedy — are a perfect way to start the conversation about relationship protections in these red states.

Documents Shine Light on Government's Interpretation of Spying Powers

The government recently released over 900 pages of records related to its implementation of the invasive FISA Amendments Act (FAA) surveillance power. Read the documents online.

In response to a Freedom of Information Act (FOIA) lawsuit filed by the ACLU, the government recently released over 900 pages of records related to its implementation of the invasive FISA Amendments Act (FAA) surveillance power.

The FAA was passed in June 2008 and gave the government nearly unfettered access to Americans' international communications.

The ACLU's FOIA lawsuit seeks records related to the government's interpretation and implementation of the FAA, including reports and assessments mandated by the law concerning how the FAA is being used, how many Americans are affected by this sweeping spying regime and what safeguards are in place to prevent the abuse of Americans' privacy rights.

Although many of these records are heavily redacted, the documents do shine some light on the government's interpretation, use, and abuse of the FAA spying power.

For instance, every internal assessment conducted by the Attorney General and the Director of National Intelligence found from the enactment of the law through March 2010 found incidents of violations of the FAA's targeting and minimization procedures. This likely means that citizens' and residents' communications were improperly collected — or improperly retained and disseminated.

The documents also confirm that the government believes the FAA allows broad surveillance powers with few external checks or limitations. In one document, the FBI claims that, under the FAA, there is "no longer a requirement for probable cause to collect data" and that there is "no need to go to court" for government officials to begin surveillance operations.

Regardless of abuse, the problem with the FAA is fundamental; the statute itself is unconstitutional. The ACLU has challenged the FAA in federal court because giving the executive branch the power to conduct dragnet surveillance of Americans' international telephone calls and emails without a warrant, without suspicion of any kind, and with only very limited judicial oversight violates the First and Fourth Amendments. The case Amnesty v. Blair is currently on appeal before the U.S. Court of Appeals for the Second Circuit.

And Justice for All?

From the execution of innocent inmates, to en masse arrest and deportation of immigrants, to torture victims denied their day in court, our new report details how U.S. victims of human rights abuses are denied access to justice. Read the ACLU's new report, "Slamming the Courthouse Doors."

Access to the U.S. justice system for victims of civil and human rights violations has been severely curbed over the last decade. Today, the ACLU released a report showing how indigent defendants on death row, prisoners suffering abuses in jail, immigrants in unfair removal proceedings, torture victims, domestic violence survivors and victims of racial discrimination — among others — are consistently denied access to justice and remedy as a result of recent laws and court decisions.

Unfortunately, because of these decisions, victims of human rights violations here in the U.S. are continually denied their day in court while those responsible for the abuses are protected. Equal justice for all is a core American value, and everyone deserves access to the courts to right the wrongs they have suffered. The U.S. should amend restrictive laws and swiftly enact policies to restore access to justice for the most vulnerable among us.

The report, "Slamming the Courthouse Doors," profiles the cases of many victims of human rights violations who have been shut out of the court house when they have sought justice from the courts, including:

Jessica Gonzales, a Colorado woman shut out of court after police failed to protect her children from her abusive husband, who killed them.
Cameron Todd Willingham and Claude Jones, two almost certainly innocent men put to death in Texas.
300+ immigrant workers in Iowa arrested and convicted en masse in one week without adequate legal representation — and deported away from their families without any court review of their valid claims for immigration relief.
Binyam Mohamed, Abou Elkassim Britel, Ahmed Agiza, Mohamed Bashmilah, and Bisher al-Rawi, victims of the U.S. torture program denied any time in U.S. courts because of the government's claims that their torture is a "state secret."
Prisoners whose lawsuit alleging an officer had forcibly sodomized them was thrown out of court because of a restrictive federal law requiring them to show physical injury in order to proceed with their case.

The cumulative effect of these cases threatens to undermine the fundamental values of this nation and shift power in ways that cannot be tolerated, inevitably leading to a less just and less free society. In this society, attacks on individual access to justice quickly become attacks on the justice system as a whole. To the extent that they are successful, they weaken not only the courts but the nation as a whole — throwing undue influence to the wealthy and powerful, stripping it away from the disadvantaged, and destroying the balance of power between the government branches that were weighted with care by our founding fathers.

More Than 1,000 Complaints Over "Enhanced" TSA Security Measures

The ACLU has received over 1,000 complaints from travelers in the United States about the TSA's new security measures. Read excerpts of travelers' complaints.

The ACLU received over 1,000 complaints in the month of November from travelers who have been subjected to the Transportation Security Authority's (TSA) new "enhanced" screening procedures. The procedures include sending travelers through backscatter X-ray machines that produce naked outlines of an individual's body or subjecting them to thorough pat-downs during which TSA agents touch travelers' breasts and genitals through the outside of their clothing.

Most of the complaints came from travelers who reported feeling humiliated and traumatized by the procedures.

The government must keep us safe, but it must do so in a way that is sensible, effective and constitutional. "The new 'enhanced' security methods are far more intrusive than other methods but have not been shown to be any more effective," said Laura W. Murphy, Director of the ACLU's Washington Legislative Office. "Nobody should be forced to choose between 'naked scans' and intrusive groping by strangers to keep our airplanes safe."
